Final Order / Judgement

Advocate Mr.Shitut is present for the appellant. As per the submission of the learned advocate for appellant this appeal has been filed against the order passed by District Consumer Commission Wardha in Consumer Complaint No.CC/21/18 order dated 29/10/2021. While filing this appeal it was noted that there is delay of 11 days and hence the appellant also filed delay condonation application (MA/22/20). The learned advocate for appellant submitted that the delay period includes the exempted period by the order passed by the Hon’ble Supreme Court of India in Suo Motu Writ Petition (Civil) No.3 of 2020 and hence as such there is no delay in filing of this appeal. Learned advocate has also filed an application seeking condonation on the basis of the order passed by the Hon’ble Supreme Court of India. We have gone through the order as well as the application which was filed by the appellant and we are satisfied that there is no delay in filing of this appeal. Hence the application filed by the appellant of condoning the delay is hereby allowed.

          Further heard learned advocate for the appellant on the point of admission of this appeal. Perused the record. The appeal is hereby Admitted. Issue notice after admission to respondent for final hearing on next date.

          Learned advocate for appellant further prayed for granting the stay to the impugned order passed by the learned District Consumer Commission Wardha. Perused the application for granting stay. The stay is hereby granted till next date after depositing the entire decretal amount after deducting the amount which is already deposited in the District Consumer Commission at Wardha within a period of four weeks from the date of receipt of this order. Stand over to 20/09/2022.
