ORDER:                    

 

                Today the case was fixed for consideration on the point of admissibility of the complaint.

2.                    This complaint has been filed by the complainants u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OPs’) on the averments that complainant no.1 had taken a Met Suvidha Participating policy no.21118671 and has deposited the premium of Rs.1773.15 paise in the year 2013 and the term of the policy was for 12 years. Complainant no.2 has also taken a  Met Suvidha Participating policy no.21127149 and has deposited the premium of Rs.2897/- in the year 2013 and the term of the policy was for 10 years. After taking the said policy the complainant started making the payment of premium amount without any default. In the month of December, 2021 the complainants approached the OP no.2 and asked them regarding the abovesaid policies then OP no.2 told that same have been lapsed and now they cannot continue the same. However, the complainants are paying the payment of the premium of said policies regularly. After knowing the said facts, complainant requested the no.2 for the refund of their entire amount alongwith interest accrued thereon and benefits of said policies but OP no.2 did not pay any heed to the genuine request of complainant and lingered the matter on one pretext or the other. Then, complainants sent a legal notice dated 21.01.2022 to the OPs in this regard but it also did not yield any result. In this way there is deficiency in service on the part of the OPs. Hence complainants filed the present complaint.

3.             Arguments on the point of admissibility heard. Record perused.

4.             A careful perusal of the file, it reveals that the complainants alleged that they had purchased the policies in question from the OPs in the year 2013  and started  making the payment of premium amount of the said policies regularly.

5.             Complainants have not placed on file the receipts regarding deposition of the premium amount with the OPs after 2013. As per the letter dated 10.11.2021, Shish Pal complainant had obtained the policy bearing no.21118671 on 06.07.2013. The mode of payment was Rs.2000/- monthly, the paying terms was twelve years and total premium paid by complainant only Rs.14,000/-. The complainant Kala Devi had obtained the policy bearing no.21127149 on 13.08.2013. The mode of payment was Rs.3000/- monthly, the paying terms was twelve years and total premium paid by complainant only Rs.9,000/-. The status of both the policies have shown as “lapsed”. It appears that complainants have not paid the premium after 2014. Moreover, the coverage term of the policy of Shishpal is twelve years and term of policy of Kala Devi is fifteen years. The policies in question had already lapsed in the year 2014 and the present complaint has been filed by the complainant on 22.03.2022.

6.             In view of the above discussion, the present complaint is devoid of any merits and deserves to be dismissed and the same is hereby dismissed. Party concerned be communicated of the order accordingly and file be consigned to the record room.
