It is stated by learned counsel for the parties that matter has been amicably settled. In pursuance thereto, respondent has filed his affidavit which is taken on record. As per the affidavit, petitioner shall pay a sum of Rs.1,50,000/- (Rupees One lakh and fifty thousand only) as compensation and Rs.20,000/- the counsel fee, to the Advocate, being as full and final settlement of the claim made by the respondent in the District Forum. Above amount shall be paid by way of demand draft in the name of respondent as well as Advocate, within ten days. It has also been agreed between the parties, that respondent/ complainant before the District Forum, shall withdraw the execution proceeding pending before it on receipt of the above amount. It has been further agreed that amount deposited by the petitioner with District Forum, in terms of order dated 28.2.2011 passed by this Commission, be refunded to the petitioner. Further, statutory deposit of Rs.15,000/- deposited with the State Commission, be also refunded to the petitioner. In view of the above statements given by learned counsel for the parties, present petition stands disposed of being compromised. Parties shall be bound by their statements. Dasti to both parties. |
