C/R is put up on prayer of both sides on the ground of compromise.

     Both parties appeared and filed a prayer for settling this case on the ground of “Solenama”.

     Put up is allowed.

     Heard the Ld. Agents of both sides.

     Both sides filed a joint “Solenama”.

     Heard the “Solenama”.

     Let the instant case be and the same is compromised as per terms and conditions of “Solenama”.

     In terms of Solenama the O.P No. 2 Bajaj Allianz General Insurance Co. Ltd. shall pay amount of Rs. 1,64,879 (One lakh, Sixty Four thousand, Eight hundred Seventy Nine) only to the O.P No. 3 Renault Siliguri, Sky Wheels Pvt. Ltd., Plot No. 312/P, Patibahan Nagar, Matigara, Siliguri – 734010  within two months from this day.

     Thus, the instant case is disposed of with full satisfaction.

     Provided that if the O.P No. 2 violates the terms and conditions of “Solenama” in that event the O.P No. 3 will be at liberty to put this “Solenama-decree” into execution according to law and in realization of the decreetal dues the O.P No. 3 will be entitled to 8% interest per annum on the decreetal dues from the date of filing of this case i.e. on 16/01/2018 till realization of the entire decreetal dues.

      Let a copy of this order be sent to the concerned parties through registered post with A/D or by hands forthwith for information and necessary action.
