Vide order dated 31.10.2013 Shri Ajit Bharihoke while sitting as a Single Member Bench passed an interim order directing opposite party No.1 to deposit in the Registry 70% of the principal amount paid by the respondent/complainant with 18% interest thereon from the date of respective deposits latest by 18.12.2013. The order has not been complied with. The petitioner/opposite party No.1 has moved a review petition. We have perused the review petition as also the record. We do not find any error apparent on the face of the record, which may call for the review of the above-noted order particularly when the order under review has been passed with a view to protect the interest of the consumer. Since opposite party No.1 has failed to comply with the order, the complainants are at liberty to seek execution of the order. Pleadings in this case are complete. Complainants are, therefore, directed to file his affidavit evidence within four weeks with advance copy to the respective counsel for the opposite parties and the opposite parties shall file their affidavit evidence within four weeks thereafter with advance copy to the other parties. List on 4.12.2014 for final disposal.
