On 2.5.2014 I.A. No.2441/2014 seeking early hearing filed by the complainants was dismissed on the ground that the instant consumer complaint cannot be given priority over the complaints filed earlier. The complainants now have filed RA No.152/2014 alleging that after the dismissal of early hearing application, the complaints filed by some other allottees involving similar question of law and fact have been decided by the Bench No.3. Therefore, it would be in fitness of the things to dispose of this complaint at the earliest. Thus, the complainants have prayed for recall of the order dated 2.5.2014 and hearing of this complaint on some early date. On perusal of record we find that pleadings in this case are complete and the parties have filed their affidavit evidence and that the case is ripe of final arguments. Since similar complaints have already been disposed of by a co-ordinate Bench, we recall our order dated 2.5.2014 and direct that this case may be listed for final hearing on 22.1.2015. Notice to the parties be also issued.
