This is a revision petition wherein prayer is made for recalling of the order dated 15.09.2014 passed by the District Forum-VII in CC No.134/2014, whereby the petitioner/OP No.2 before the Ld. District Forum has been proceeded ex-parte.
It is informed that the matter is still pending before the Ld. District Forum and the next date is 23.08.2017.
There is also an application for condonation of delay in filing this petition.
Initially counsel for the respondent/complainant opposed the application for condonation as well as the revision petition. However, after some arguments, it is stated that the respondent/complainant has no objection if the delay is condoned and impugned order is set aside subject to payment of costs.
Accordingly, with the consent of the respondent/complainant as well as for effective disposal of the case on merits, subject to payment of costs of Rs.7,000/- to the respondent/complainant, we condone the delay as well as accept this petition and set aside the order dated 15.09.2014 qua the petitioner/OP No.2 only.
The petitioner/OP No.2 shall filed its written statement within 30 days from today and shall pay costs to the respondent/complainant within the aforesaid period. For the said purpose the parties are directed to appear before the Ld. District Forum on 24.03.2017. Thereafter, the District Forum shall proceed further in the matter in accordance with law.
The petition stands disposed of accordingly.
Copy of this order be given to the parties and be also sent to the District Forum-VII, New Delhi for information.
File be consigned to Record Room.
