Heard learned counsel for the parties. Learned counsel for the petitioner submitted that matter was dismissed in his absence hence petition may be accepted and the matter may be remanded back to the State Commission for disposal on merits. On the contrary, learned counsel for the respondent submitted that the petitioner failed to appear before the State Commission on four dates hence petition may be dismissed. It is true that the petitioner failed to appear before the State Commission on 28.04.2010, 21.09.2010, 14.12.2010 and 03.08.2011 and in such circumstances, learned State Commission rightly dismissed appeal in the absence of the petitioner but in the interest of justice matter may be remanded back to the State Commission for disposal on merits. Consequently, the petition is accepted and order of the learned State Commission dated 03.08.2011 passed in F.A. No.1255/2007, Punjab State Electricity Board Vs. Paras Ram Bansal is set aside subject to payment of Rs.5,000/- as cost to the respondent and matter is remanded back to the State Commission for disposing the appeal on merits after giving opportunity of being heard to both the parties. Parties are directed to appear before the State Commission on 30.10.2012.
