On the last date of hearing, counsel for the appellant had sought adjournment on the ground that talks for out of court settlement were going on between the parties.

             Today counsel for the appellant states that an out of court settlement has been arrived at between the parties and he may be permitted to withdraw the appeal.  Allowed. 

             Appeal is dismissed as withdrawn.
