Learned counsel for the complainants filed an application that the court fee of Rs.5,000/- be refunded/adjusted in the matter as the original complaint No.1094 of 2017 filed by the complainant under Section 12(1)(c) of the Consumer Protection Act, has been withdrawn and liberty has been granted by this Commission vide order dated 04.10.2017 to file individual complaints.  The learned counsel was heard on the matter and she submitted a judgment in consumer case No.643 of 2016, Mohit Chaudhary Vs. M/s. Ramprastha Promoters & Developers Pvt. Ltd., decided on 04.05.2016 (NC), wherein the refund of court fee has been ordered.  In the referred case, the matter was not heard on merits, however, in the present case the matter was heard on merits.  As the Commission has toiled to hear the complaint and the order has been passed after hearing the learned counsel for the complainants as well as on  the  basis  of  the  application moved for withdrawal of the complaint, the purpose of taking the court fee has already been served and the court fee becomes exhausted. 

          In these circumstances, I do not deem this to be a proper case for refund/adjustment of the fee of Rs.5,000/-.  Accordingly, the application is dismissed.
