ORDERS
1. This is a complaint of alleged deficiency of service filed under section 12 of the Consumer Protection Act,1986 by G.V. Basavaraj the Complainant against the Opposite party (for short ‘OP’) praying to grant compensation of Rs. 6,53,395/- and 12 % interest from dated 28/03/2017 towards compensation for deficiency of service, for mental agony, for expenses and cost of the proceeding - etc.
2. During evidence stage both parties filed joint meme agreeing to compromise the case and submitted that the complainant has agreed to receive Rs.6,60,000/- from the OP as full and final settlement and withdraw the complaint.
In view of the submission made by both parties and counsels, and joint memo filed by both the parties, we pass the following order.
Orders.
Present complaint is partly allowed.
OP is directed to pay Rs.6,60,000/- to the complainant within 30 days from the date of receipt of this order. In case of non-compliance of the order the entire amount shall carry interest @ 10% per annum till its realization.
Parties shall bear their own cost.
The assistant registrar is directed to send free copies of this order to the all the parties free of cost within a week from today.
