Order No. 12, Dated: 10.07.2018
This order is arising out of the M.A. being No. 25/2018 filed by the complainant in the C. C. No. 214/2017 praying for amendment of the cause title of the complaint petition as mentioned in the schedule below.
It is stated by the complainant in the said M.A. that after hearing summons were sent upon the Ops, but summon upon OP-3 has been returned. Thereafter the complainant came to learn that some mistake has been taken place in the address of the OP-3 as well as in the cause title of the complaint. This mistake is typographical mistake and due to inadvertence or otherwise the mistake has been taken place. Therefore, the mistake in the address of the OP-3 should be corrected by way of amendment as well as by way of proper order of this Forum. So prayer is made by the complainant to pass appropriate order by amending the cause title of the complaint as mentioned in the schedule below otherwise the complainant will suffer irreparable loss and injuries. The OP-1 & 3 has received the copy of the said application. The ld. Counsel for the OP-1&3 have raised no objection against such application.

We are of the opinion that the amendment as sought for by the complainant is formal in nature and it will not change the nature and character of the complaint. Therefore, the amendment as sought for by the complainant should be allowed. Hence, it is

that the Misc. Application being No. 25/2018 be and the same is allowed on contest without any cost.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
