The complaint is allowed. 

Complainant is awarded full refund of purchase price of his vehicle i.e. a sum of Rs.1,91,045/- together with simple interest at 9% per annum thereon from 17/10/2007 (being the date of filing of this complaint) till date of actual payment.

Complainant shall return the suit defective vehicle to Opposite Party-1 together with its Registration Certificate and also sign all relevant papers as required by Opposite Parties to transfer ownership of the vehicle back to themselves.

A period of over 7 years has elapsed since the filing of this complaint. In case hence, if Complainant is no longer now in possession of the vehicle and therefore unable to return it, the sum refundable in 2. above shall read as Rs.1,62,000/- and 3. above shall not be applicable.

Complainant is further awarded compensation for harassment caused and towards loss of income, totalling to to Rs. 50,000/- and costs of Rs. 5,000/-.

Both Opposite Parties are jointly and severally liable to comply above directions and shall do so within 60 days of date of this order.
