          This is a complaint filed u/s 12  of Consumer Protection Act, 1986 for directing the Opposite Parties  to rectify the defect of the Refrigerator of the complainant or replace it with a new one of the same model;  to pay a sum of Rs.50,000/- as compensation for the mental pain and loss of the complainant due to deficiency of service.        

          2. Notice to the opposite parties were duly served. The first opposite party appeared through Counsel, second opposite party remained absent and set ex parte.  The complainant was examined as CW1 and Exs.C1 to C5 were marked.  The complainant was also cross-examined partly.  Hence, the matter was posted for continuation of cross-examination of CW1. 

          3. Today this complaint was called.  Complainant / CW1 present.  OP1 present.  Counsel for both sides present.  Advocate Mr. Jijesh Kurikalat filed vakalat along with the earlier Advocate for OP1.  CW1 cross examined in part and the parties to this complaint and Counsel for both sides filed joint compromise memo.  In view of the joint compromise memo, this complaint is hereby dismissed as withdrawn.   The contents of the joint compromise memo shall form part and parcel of this order.

          1. The dispute between the complainant and opposite parties settled amicably with full satisfaction.  As per settlement first opposite party delivered LG Refrigerator having a worth of Rs.24,190/- which is a new model in the market.  The complainant is satisfied and accordingly withdrawing the above complaint.

 

2. Therefore, this Hon'ble Forum may be pleased to receive the compromise memo on the file of this Hon'ble Forum and may dispose the above complaint in the light of settlement between parties.
