The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder.
The Complainant’s case is that he has a customer transaction with the O.P./Dealer by purchase of various electronic items from time to time. On 11/03/2023 the Complainant purchased a Refrigerator (Haier Brand) and Model-HRD 2062 BRB-S-RJOPG from O.P. for Rs.13,000/- under Receipt No.6252 out of which he paid Rs.3,000/- in cash on 06/04/2023 under Receipt No.124 and a Cheque bearing No.000016, dt.11/03/2023 drawn on UCO Bank, Machantala was issued for balance payment of Rs.10,000/- in favour of the O.P./Dealer. The Complainant got delivery of the Refrigerator but did not get any satisfactory service after installation. The O.P./Dealer neither encashed the Cheque nor returned the same to the Complainant. Hence this case.
O.P. contested the case by filing a written version contending inter alia that the Complainant is liable to pay the balance amount of Rs.10,000/- to the O.P. and unless this amount is paid further service cannot be offered.

-: Decision with reasons:-
Having regard to the facts of the case, contention, submission and documents on both sides the Commission finds that at the time of purchase of the Refrigerator plain bill without calculation of GST was issued to the Complainant but at the time of hearing Ld. Advocate for the O.P. furnished before the Commission computerized regular bill with GST and he undertakes to furnish the same to the Complainant. The Complainant has agreed at the time of hearing to make the balance payment of Rs.10,000/- to the O.P. On such undertaking and arrangement between the parties the case is disposed of on contest to the following effect: -
The Complainant is directed to pay to the O.P. Rs.10,000/- on proper receipt within a fortnight from this date in default law will take its own course and in the mean time computerized Invoice as filed before the Commission be supplied to the Complainant and on receipt of the decretal amount the O.P. will provide proper service and maintenance of the product as and when required within the Warrantee Period.
Both parties be supplied copy of this Order free of cost.
