                    Sh.Narain Sharma, Chief Manager, Oriental Bank of

       Commerce/respondent alongwith counsel Sh.B.B.Sharma, Adv.   

                   Sh.Narain Sharma, Chief Manager, Oriental Bank of Commerce, Sarabha Nagar, Ludhiana has suffered a statement that a sum of Rs.25,000/- has already been deposited in the Hon’ble State Commission, on 23.01.09 and sum of Rs.15,000/- has already been deposited with the Hon’ble State Commission on 25.02.09 and thereafter the cheque for an amount of Rs.40,000/- + Rs.15,444/- as interest was sent to the complainant Madan Katyal by the account branch of the Hon’ble State Commission, which was received back undelivered with the report ‘left’. Thereafter, the bank has also filed Review Petition before the Hon’ble State Commission, which is fixed for 25.3.15 for notice to Madan Katyal. In view of the order dated 15.01.13 passed by Hon’ble State Commission, we are submitting DD no.983103 dated 21.01.15 amounting to Rs.13,717/- favouring Madan Katyal s/o Mehnga Ram complainant towards the full and final settlement of the claim of the complainant alongwith calculation.

          On the other hand, Sh.Narinder Chhibha, Adv. for applicant has suffered a statement that today on behalf of the applicant/Madan Katyal, he has received the DD no.983103 dated 21.01.15 amounting to Rs.13,717/- favouring Madan Katyal s/o Mehnga Ram in the Forum. The applicant has not received the amount deposited with the Hon’ble State Commission, and the applicant will pursue to get the amount released from the State Commission. If the amount is not paid by the State Commission or there would be any calculation difference, the applicant will puruse his remedy.  In view of the aforesaid statement, he withdraws the present application without prejudice to the rights of the applicant.

          In view of statement suffered by Ld. counsel for applicant, the present execution application stands dismissed as withdrawn.  However, applicant is at liberty to file fresh execution, in case, the applicant will not receive the amount from the Hon’ble State Commission or there is any difference of calculation. File be consigned to record room.
