We have perused the complainant petition and the documents enclosed therewith.

We find that the complainant has not impleaded the proprietor of the Hotel where he had stayed. According to us the Proprietor of the Hotel is a necessary party. Learned Advocate for the complainant has sought for withdrawal of the complaint with a liberty to file fresh complaint. As per our direction Learned Advocate for the complainant has submitted a petition praying for withdrawal of the complaint with liberty to file fresh complaint.

The prayer stands allowed.

With this observation, the instant complaint is accordingly dropped.
