ORDER
Vakalatnama and two applications, i.e., one application for dismissal of the complaint in view of the law laid down in Ambrish Kumar Shukla vs. Ferrous Infrastructure Private Limited and one application under Section 8 of the Arbitration and Conciliation Act, 1996, read with Section 5 of the Act for referring the matter to Arbitration, have been filed on behalf of OPs. For reply and consideration on the applications, listed for 18.01.2017.

After the case was adjourned, Sh.Navneet Jindal, Counsel for Complainant has appeared at 12.15 PM and he has made statement in the shape of endorsement on the order sheet itself that in view of the judgment passed by Hon’ble National Commission in Ambrish Kumar shukla vs. Ferrous Infrastructure Private Limited in CC/97/2016 decided on 07.10.2016 and in view of judgment of Hon’ble National Commission in RP No.2493 of 2011 decided on 14.02.2012 (2012(2) CPJ 18), he withdraws this complaint at this stage to be filed before Hon’ble State Commission within reasonable time after removing defect if any. In view of the said statement in the shape of endorsement made by counsel for complainant, this complaint is dismissed as withdrawn with liberty to the complainant to file before the Hon’ble State Commission after removing defect, if any.

     Certified copies of this order be sent to the parties free of cost. The file be consigned
