1.       Learned counsel for the petitioner submits, on instructions, that he does not wish to press the second appeal and may be permitted to withdraw the same with liberty to file another petition as permissible under law. 

2.       In the wake of the submissions made, the second appeal stands dismissed as withdrawn with liberty to file another petition, as the petitioner may be advised, within a month from today.

3.       It may also be observed that the time taken from today onwards till filing of another petition may not be counted towards period of limitation. 

4.       The Registry is requested to send a copy each of this Order to all parties in the second appeal and to their learned counsel. The stenographer is requested to upload this Order on the website of this Commission immediately.
