ORDER

Present:        Ms. Muskan Arora, Advocate for the complainant alongwith complainant.

Sh. Rajender Verma, Advocate for OP no.1.

 

           Case file taken up today on the application moved by counsel for the complainant. The counsel for the OP no.1 Sh. Rajender Verma has made no objection upon the application. Learend counsel for the OP no.1   has made a statement that the matter has been compromised and  the insurance company is ready to make the payment of Rs. 92,000/-(Ninty Two Thousand Only)  towards full and final settlement of the claim of the complainant. He further stated that the aforesaid amount shall be paid by the Insurance company within 30 days from the date of passing of order. Complainant has also made a statement that he is ready to get the aforesaid amount of Rs. 92,000/- in full and final settlement of claim and further prayed that if the company fails to make the payment of aforesaid amount within 30 days in that eventuality the interest @9% per annum from the date of filing of complaint till payment may kindly be awarded. Statement to this effect recorded separately.

In view of the statement made by the parties, the present complaint is disposed off with the direction the Niva Bupa Health insurance company shall make the payment of Rs. 92,000/- within 30 days, if the insurance company fails to make the payment of aforesaid amount within 30 days, the insurance company shall be liable to pay interest @9% per annum from the date of filing of complaint till payment. Complaint stands disposed off accordingly. File be consigned to the record room after due compliance. Copy of order be supplied to the parties free of cost.
