 Ld. Advocate for the Appellants is present . Respondent is absent. The delay condonation petition of the Appellant is taken up for hearing. Ld. Advocate for the Appellant submits that there has been a procedural delay in preferring the appeal which took 99 days including the statutory period of 30 days , and that the impugned order has been passed exparte in the absence of the Appellants/OPs , as Mr. Akramul Haque ,  Ld. Advocate appointed in the matter did not fight  the case  in any way,  and so the delay be condoned. Considering all the aspects into the matter, there seems to be no vigilance on the part of the Appellants in conducting their cases before the Consumer Forum . Such a practice should not be given indulgence . The delay is not properly and justifiably proved in order to condone the delay. Hence, the delay prayer cannot be acceded to, and rejected . Consequently, the appeal is dismissed being barred by limitation.
