1.   It has been submitted by the learned counsel, on instructions, that he may be permitted to withdraw the second appeal and may also be given liberty to file revision petition in its place.

2.   In the wake of the submission made by the learned counsel for the appellant, the instant second appeal stands dismissed as withdrawn with liberty to file another petition as permissible under the law as the appellant may be advised within one month from today.

3.   However, it may be further observed in the interest of justice that in case the appellant files the revision in place of this second appeal within one month from today, the time taken in filing the revision petition from today onwards would not be counted towards the period of limitation.   

4.   The Registry is requested to send a copy each of this Order to the parties of the second appeal and to the learned counsel for the appellant as well as to the fora below within three days from today. The stenographer is requested to upload this Order on the website of this Commission within three days from today.
