          This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

2.       This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. The opposite party entered appearance and filed written version denying the allegation of deficiency in service raised by the complainant against the opposite parties. When the case came up for consideration today, it is found that the notice issued to the complainant was seen returned with endorsement “addressee expired” and the same was recorded on 24.02.2022. Subsequently the case was adjourned to this date to ascertain whether the legal heirs of the complainant are willing to further proceed with the case or not. As the legal heirs of the deceased have not taken any steps to implead themselves to further proceed with this case, we find that the legal heirs of the complainant are not interested to further proceed with this complaint. In view of the death of the complainant and the absence of any legal heirs to implead themselves to proceed this case, we find that this is a fit case to be dismissed.

     In the result, the complaint is dismissed. There will be no order as to costs.

      A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
