The complainant filed this complaint alleging deficiency in service against the opposite party and claimed hospital expenses with interest and for compensation.

 

Opposite party, National Insurance Co. Ltd. represented by manager and filed written version stating inter-alia that opposite party has not received claim from the complainant.

 

On 24.12.2019, complainant filed an application stating that considering the non-receipt of claim by opposite party, he is ready to submit fresh claim before the opposite party and for enabling to file the same, he may be permitted to withdraw the present complaint with liberty to file fresh complaint if necessary.

 

We have considered the application and considering the facts of the case, application allowed and the complainant is permitted to withdraw the
