Mr. Aditya Narain, Ld. Counsel for the Appellants states that during the pendency of this Appeal, the dispute, subject matter of the Complaint, leading to the filing the present Appeal, has been amicable settled out-of-Court with the Complainant. He submits that in view of the said settlement, which has been arrived at keeping in view the peculiar facts of the case, he has instructions not to press the present Appeal. In view of the submission, the Appeal is dismissed as -2- not pressed. It goes without saying that we have not expressed any opinion on the merits of the Appeal. Since the dispute, subject matter of Appeal has been amicably settled between the parties, it is agreed between the Appellants and the Complainant that the amount deposited in this Commission in terms of the order dated 23.11.2016, shall be permitted to be withdrawn by the Appellants, alongwith accrued interest, if any. It is ordered accordingly. The statutory deposit at the time of filing this Appeal, shall be refunded to the Appellants. |
