Mr. S. V. Joga Rao, learned counsel representing the appellants and Ms. Vaijyanthi Girish, learned counsel representing the respondents states that the parties have settled the matter amicably in the manner that on the withdrawal of the allegations made by the complainants in their complaint, as a goodwill gesture, the appellants-Nursing Home and Dr. Udaya S. Shetty shall pay a total sum of Rs. 3,50,000/- to the respondents. A sum of Rs.1,50,000/- having already been deposited in the State Commission and the balance amount of Rs. 2 lakh shall be paid by the appellants to the respondents within four weeks from today. The appeal is accordingly allowed in terms of the settlement and the finding and order passed by the State Commission is hereby set aside and the complaint is dismissed as withdrawn. The State Commission is directed to disburse the deposited amount of Rs.1,50,000/- alongwith accrued interest, if any, to the respondents and the balance amount of Rs. 2 lakh shall be paid directly by the appellants to the respondents by means of a demand draft within a period of four weeks. The parties are left to bear their own costs.
