Complainant and counsel called out, absent. No representation on behalf of complainant. OP counsel opposed for any more adjournment for the affidavit evidence of the complainant. We have perused records and ordersheet and noticed that this case was posted on 21.06.2022 for evidence of complainant, since then till today the complainant does not turned up and shown any interest to file affidavit, inspite of giving more than seven(7) months time. Moreover, on 26.07.2022 on 30.08.2022 and on 29.09.2022 this case was adjourned on payment of cost of Rs.500/- each on the said dates. Inspite of it, the complainant not present not paid the cost of Rs.1,500/- imposed and finally this case was posted to this day for leading evidence complainant, even then complainant not present and not filed affidavit. It shows that, the complainant is not interested to prosecute the case and in view of non-filing of the affidavit, the complainant not proved his complaint. Therefore, the complaint of the complainant is dismissed for default /non-prosecution.
