Present application has been moved by learned Counsel on behalf of applicant/appellant in Appeal No. 1126 of 2008 M/s. Tractor and Allied Agency and another V/s Mustaq Ali Khan  for refund of Rs.25,000/- deposited by appellant under Section-15 of the Consumer Protection Act 1986 in this appeal.

Copy of judgment and order dated 07-06-2017 passed by a bench of this State Commission in said appeal has been annexed with the application. It shows that appeal has been allowed. The impugned judgment and order passed by the District Consumer Forum has been set aside.

In view of above, the above amount deposited in the above appeal under Section-15 of the Consumer Protection Act 1986 shall be refunded to the appellant alongwith interest, if any, accrued in accordance with rules.

With regard to refund of Rs.50,000/- deposited by the appellant before District Consumer Forum in compliance of interim order dated 13-06-2008 passed by this Commission, it will not be appropriate for this Commission to pass any order at this juncture. The District Consumer Forum shall pass appropriate order for disposal of said amount keeping in view the judgment and order passed by this Commission in above appeal.

Application is disposed of accordingly.
