          None is present for the appellant and respondent. Perusal of the record and proceeding of the appeal shows that appellant’s advocate Mr. Kothari had appeared lastly before this Commission on 17/7/2015. Thereafter appeal came to be adjourned thrice, that is on 26/10/2015, 8/2/2016 and 13/4/2016 for filing W.N.A. by the appellant. Neither appellant appeared on those three dates nor filed W.N.A. Therefore on last date this Commission observed that the appeal deserves to be dismissed in default. The appeal came to be adjourned as a last chance till this date to the appellant. Today also none appeared for the appellant. Hence appeal be recalled at the end of the board for appropriate order.

          The appeal is re-called at the end of the board for appropriate order. Presently also none is present for the appellant though advocate Mr. Saoji is present for respondent Nos. 1 and 2. He also submitted that appeal may be dismissed in default. As none appeared for the appellant on last three dates as above and as the appellant has not filed written notes of arguments, the appeal is dismissed in default.
