The case  of the complainant is that,  
 
Complainant  and his wife  Rajimol are Government Employees.  They tried to purchase a plot along with a newly builded house in Thodupuzha with the help of one Aboobecker.  On enquiring through a broker the complainant and his wife got information about a plot having 2.49 Arcs in area in Karikkodu Village, Thodupuzha Taluk and a residential building is under construction therein.  On further enquiry it is learnt that this property is owned by one Safin Jaffar, Chelattil House, Fathimapuram, Changanassery, the brother-in-law of the opposite party.  At that time opposite party himself stated that, he is having Power of Attorney of his brother in law Safin Jaffar for selling his property.  After negotiation the value of the property is fixed for Fourty Lakhs and the complainant given Rs.1000/- as token.  Thereafter on 26/08/17, the opposite party received an amount of Rs.One Lakh from the complainant as advance amount of the said property on the pretext that, he is the Power Attorney Holder and agreed that, the property will be handed over to the complainant by completing the construction of the building within 23/11/17 and executed a sale agreement on the same date itself.

For purchasing this property complainant approached Alahabad Bank, Thodupuzha Branch and applied for a housing loan, on 18/11/17.   Before the date of invalidating the sale agreement the loan sanctioned.  This  matter is intimated to the opposite party immediately and complainant approached him for executing the sale deed.  But the opposite party withdrawn from the agreement and cheated the complainant without executing the sale deed in his favour.  On further enquiry the complainant came to know that, the construction of the building is not completed, and having no electric connection.  Thereafter the complainant and the broker approached the opposite party so many time, but the opposite party responded indecently.  On further enquiry complainant got information that the General Power of Attorney which is produced by the opposite party at the time of executing the sale agreement was fake and forged one and the actual Power of Attorney Holder is one Saira Jaffar, the sister of the property owner.    Thereafter the complainant and his friends approached the opposite party and demanded back the advance amount, but he evaded from paying the amount.  In the mean time, due to this reason the complainant forced to close the purchase loan by paying Rs.29,000/- as interest.  Due to the above said act of the opposite party, complainant had to suffer a lot both mentally and financially.  The act of the opposite party is gross deficiency in service and unfair trade practice  and the complainant approached the Forum for getting relief such as to direct the opposite party to return the amount of Rs.1,01,000/- which he received from the complainant also direct him to pay Rs.29,000/-, the bank charges remitted by the complainant and also direct him to pay cost.
 
Notice issued to the opposite party from the Forum returned as unclaimed and after giving sufficient time for appear once, the Forum set the opposite party exparte and the case was posted for exparte evidence.
 
Evidence adduced by the complainant by way of documents which are marked as Ext.P1 to Ext.P8.  Ext.P1 is the copy of title deed, Ext.P2 is the copy of  Tax Receipt, Ext.P3 is the  Primary Sale Agreement, Ext.P4 is the copy of Power Attorney  in the name of opposite party, Ext.P5 is the copy of Power Attorney in the name of Saira Jaffar,  Ext.P6 is the loan sanction letter,  Ext.P7 is the loan closing letter,  Ext.P8 is the receipt of remittance of Rs.29,000/-.

The point that arose for consideration is whether there is any deficiency in service from the part of opposite parties, and if so, for what relief the complainant is entitled to ?
 
The Point:- On going through the averment of the complainant and on perusing the exhibits, the Forum is of a considered view that since the averments of the complainant and documents adduced for evidence are unchallenged, the entire version of the complainant is believable and he is entitled to get the relief as sought for.
 
Hence complaint allowed.  Opposite party is directed to pay an amount of Rs.1,01,000/- along with interest @ 12% from 23/11/17 and also directed to pay Rs.29,000/- being the penalty, that the complainant remitted in the loan account.  Opposite party further directed to pay Rs. 5000/- as litigation cost to the complainant within 30 days from the date of receipt of the copy of this order,  failing which the amounts  stated above except the cost shall carry 12% interest per annum from the date of default  till the realization.
