As per the order of this Forum, amount of Rs.175500/- has been paid to the legal heirs of deceased Rajinder Khanna namely Meenakashi Khanna ( wife ), Raghav Khanna ( son ), Smt.Sheela ( mother ), Miss Roshni alias Kashish Khanna( daughter ) in equal share of Rs.43875/- each i.e. vide cheque No.974748 dated 4.2.2020 in the name of Meenakashi Khanna, 974749 dated 4.2.2020 in the name of Raghav Khanna, 974751 dated 4.2.2020 in the name of Smt.Sheela, 974750 dated 4.2.2020 in the name of Miss.Roshni alias Kashish Khanna under proper receipt and indentication for payment to them. Their statements have been recorded separately.
Hon’ble State Consumer Disputes Redressal Commission, Punjab Chandigarh vide order dated 13.12.2012 has modified the order of the District Forum and reduced the amount of insurance to Rs.3 lac instead of Rs.10 lac and also reduced the amount of compensation to Rs.50000/- instead of Rs.2,00,000/- and litigation expenses to Rs. 50,000/-. In all, Hon’ble State Commission has awarded Rs.3,50,000/- to the complainant. As per the version of the applicant, opposite party has already paid Rs.175000/- to the complainants which were accepted by them without prejudice to the right of the complainants in the pending appeals before the Hon’ble National Commission and while reserving their rights of enhanced amount in the appeal pending before the Hon’ble National Commission. Now the legal heirs of the deceased Rajinder Kumar have received Rs.175500/- out of Rs.350000/- awarded by the Hon’ble State Commission. Consequently, present execution application is disposed off accordingly subject to the decision of the Hon’ble National Commission, New Delhi in appeal pending. File be consigned to the record room.
