ORDER

Mr. RAVISHANKAR, JUDICIAL MEMBER

Advocate for appellant submits that they have filed an application for impleading the Manufacturer in this appeal on 02.09.2014 itself.  On 06.01.205 the case was posted for hearing on the application.  Anyhow the appellant had amended the appeal memorandum by impleading the Manufacturer.  Now at this junction of time on perusal of the Order passed by the District Commission, the complaint was dismissed for the reason that the Manufacturer was not made as a party before the District Commission.  Hence, it is proper to remand the matter to the District Commission and provide an opportunity to bring the Manufacturer on record by receiving an application and dispose the matter after receiving objection and evidence from both the parties on merits.  Accordingly, the appeal is disposed-of.
