The Complainant and his counsel were present, so also the learned counsel for the Op.no.1 was present.
ORDER
Compromise Memo dtd.02.03.18 filed by both parties is duly signed by the Complainant as well as contesting Op.no.1. The contents of the said memo read over and explained to the Complainant in the presence of his counsel and also to the learned counsel for the Op.no.1, who admits the contents of the compromise memo which are true and correct.
2. We have gone through the contents of Compromise Memo which are not extraneous to the pleadings of the parties to the lis, hence we do not find any impediment to allow the said Compromise Memo. Accordingly it is allowed.
3. The learned counsel for the Op.no.1 filed memo dtd.02.03.18, stating that, the alleged Varna Car of the Complainant bearing Reg.no.KA51 MB6678 completed the pre-delivery inspections and it is ready for delivery and Complainant is at liberty to pick up the said car. On being questioned, Complainant submits that, he is ready to take back the said car. Accordingly his submission is recorded. In this view of the matter, we are of the opinion that, matter is deserves to be closed as settled between the parties to the lis.
4. Both parties are directed to bear their own cost.
