Complainant had secured a reservation vide ticket no. 1292 for a 1 day Thirupati tour on 22.12.2012 with OP no. 1.

       It is alleged by the complainant that Tour guide Mr. Dinesh arranged by OP No. 1 informed the complainant that Seegra Darshan Entry (Special Darshan) was barred on 22.12.2012 on account of coming Vaikuntha Ekadashi function.

       It is further alleged by the complainant that he reached Thirumala at 13:00 hrs and was left stranded for almost 2 hours on one pretext or the other, he ultimately returned without getting to have a Darshan of the Thirupathi temple.

       It is alleged by the complainant that OP were fully aware of the fact that Seegra Darshan Entry is barred on this day i.e. 22.12.2012 on account of Ekadasi Function and despite this OP booked his ticket with the intention to deceive him.

       It is further alleged by the complainant that on enquiry he came to know that this was annual practice which is followed year after year and everyone in this region is aware of this. It is alleged by the complainant that he had planned the alleged tour for Seegra Darshan, and due to the negligence and omission on the part of OP, he failed to get the Seegra Darshan.

       Complainant take up the present matter with the OP, and as such OP refunded an amount of Rs. 900/- against the total sum of Rs. 54,855/- spent by the complainant. It is alleged by the complainant that the OP had planned the alleged ….. for Seegra Darshan and the Darshan was not possible because of the deficiency in service on the part of OP. hence this complaint.

       Notice of complaint was sent to the OP through Regd. AD post for 29.04.2014, on 29.04.2014 counsel for OP appear and filed MoA, copy of complaint supplied, since none appeared on behalf of OP , on 03.07.2014 it was ordered to be proceeded with ex-parte.

       Complainant filed his evidence by way of affidavit wherein he has corroborated the contents of his complaint.

       This case was already reserved for order on 30.01.2015, but on account of changed of Ld. Member etc. then outgoing Ld. President of this District Forum fixed this case for re-argument on 05/07/2016. On 05/07/2016 none appeared on behalf of OP but complainant was present whose written arguments are already on record.

       We have heard arguments advanced at the bar and have perused the record.

       Complainant has placed on record the copy of e-mail dated 12.12.2012 for booking TTDC package, copies of Air Ticket, copies of e-mail exchange between the parties, copy of legal notice dated 29.03.2013 alongwith its postal receipt and copy of reply of OP no. 1 dated 25.04.2013 in support of his case.

       We have carefully gone through the complaint and annexures filed with it vide e-mail dated 17.01.2013, OP admits that the inconvenience was caused to the complainant and as such offer free tickets to him and his family for Tirupathi Tour.

 

This final order be sent to server (www.confonet.nic.in ). A copy each of this order each be sent to both parties free of cost by post.
