Appellant has impugned the interim order dated 13.7.2012 passed by the State Commission in which the Appellant has been directed to comply with the Award dated 23.12.1998 failing which the Chief Administrator, HUDA should appear personally before the Commission for compliance.

          Counsel for the Appellant contends that the order dated 23.12.1998 passed by the State Commission was varied by the National Commission in FA No. 35 of 1999 filed by the Appellant.

          We have gone through the order of the State Commission dated 23.12.1998  as  well as the order dated 30.6.2008 passed by the National Commission in FA No. 35 of 1999.   The  order  passed  by  this

Commission does not either vary or set aside the findings recorded by the State Commission in its order dated 23.12.1998.

          Since the order of the State Commission dated 23.12.1998 was neither varied nor set aside by the National Commission, the Appellant is required to implement the same in accordance with law.  No ground for interference in the appeal is made out.  Dismissed.
