Complainant and Op No.2 are present. The complainant submits if the Ops are agreeable to replace the old mobile set with a new one as agreed by them and to pay the cost of this proceeding, he has no objection for recording the same and to close the complaint.   Op No.2 is agreeable to replace the old mobile set with same brand and model new set and submits that the cost is concern, he will leave it to the forum.   The complainant submits to have incurred an expenditure of Rs.2,600/- which in our view found to be reasonable.   The Ops if they had attended the grievance of the complainant situation would have not compelled the complainant to approach this forum.    Therefore, Op cannot escape of paying the expenditure of the complaint.   With this, we dispose off the complaint and pass the following order.

O R D E R

              Complaint is allowed.   Ops 1 and 2 are jointly and severally held as liable and they are directed to replace the old set with a brand new mobile set of the same brand and same model within 15 days from the date of this order and shall also pay Rs.2,600/- towards cost to the complainant.

              Complainant shall return old set to the Ops on their providing new set and cost.
