Learned Counsel appearing for the Complainant submits that in view of the decision of the Hon’ble Supreme Court in Pratibha Pratisthan & ors. Vs. Manager, Canara Bank & Ors. in Civil Appeals No.3560 and 3561 of 2008, the Complainant may be permitted to

withdraw the Complaint with liberty to the legal representatives to file fresh Complaint(s) in respect of the same cause of action.

        Accordingly, the Complaint is dismissed as withdrawn with liberty as prayed. 

        It goes without saying that we have not expressed any opinion either on the merits of the present Complaint or on the question of maintainability of the Complaints proposed to be filed.
