Learned counsel for the appellant states that against the order of the State Commission dated 28.05.2013, an appeal was preferred before this Commission on 05.07.2013. After that, the complainant/ appellant also filed an execution before the Executing Court and the execution was finalized after the settlement entered into between the parties and the possession has been taken by the appellant. However, there are still certain charges which are being demanded by the opposite party. He further states that the settlement terms on which the execution was decided have not been complied /observed by the opposite party. In these circumstances, he wishes to withdraw the present appeal and wants liberty to go before the Executing Court and to press for the agreement of settlement before the executing court.

        Accordingly, the appeal is dismissed as withdrawn with liberty to the appellant/ complainant as prayed for.
