Later advocate for complainant has filed a memo seeking permission to withdraw the complaint to present afresh as per the procedure available under law.   We have heard the counsel for the complainant regarding maintainability of the complaint, the complainant failed to exercise his right of demanding for correction of the alleged defective works if any or for payment of damages when he took possession of the flat by paying balance money and he do not raise any objection so far as his right is concerned and has come up with this complaint after lapse of some time alleging certain deficiencies.   Therefore, question of reserving liberty to file a fresh complaint as per law do not arise.  Hence, the complaint is dismissed as withdrawn.
