ORDER

I.A. No.1 of 2010 The application is for impleadment of M/s Parsvnath Developers Ltd. in place of M/s Parsvnath Landmark Developers Pvt. Ltd. The application is opposed by the counsel for the opposite party and the proposed opposite party to be arrayed. However, learned counsel for the opposite party has no objection if the counsel for the complainant withdraws the present complaint and files a fresh complaint with appropriate description of opposite party and in that case, there will be no objection of limitation from the side of opposite party / proposed opposite party. In the circumstances, the application is disposed of as also the complaint is disposed of with liberty to the complainant to file a fresh complaint against M/s Parsvnath Developers Limited within a period of two weeks. No objection in regard to limitation, the complaint being barred by limitation, shall be raised in those proceedings. In view of the special circumstances, court fee paid, if any, on this complaint shall be adjusted against the complaint which complainant proposes to file.
