Total cost of the flat was Rs.11,66,500/-.  State Commission returned the complaint to the appellant for presentation before the appropriate Commission.  Instead of filing the complaint before this Commission, appellant has filed the present appeal. 

Counsel for the appellant seeks to withdraw this appeal with liberty to file fresh complaint on the same cause of action.
