Heard. Delay condoned. Learned counsel for the respondent states that there is no objection if the impugned order is set aside and the present appeal is allowed, subject to payment of cost and the matter be remanded to the State Commission to decide the appeal on merits. In view of the above statement made by the learned counsel for the respondent, the impugned order passed by the State Commission is set aside and the complaint filed before the State Commission stand restored, subject to payment of cost of Rs.10,000/- (Rupees ten thousand only). Cost be paid to the respondent directly by way of demand draft within a period of four weeks. In the case the appellant fails to pay the cost the within the specified period, the appeal shall stand dismissed automatically without any further orders. Consequently, we remand the matter to the State Commission for deciding the matter afresh after giving due opportunities to both the parties. Parties are directed to appear before the State Commission on 3rd April 2014. With these observations, present appeal stand disposed of. Dasti in addition.
