Today is fixed for hearing of the Ld. Advocate on the issue as to admissibility of the complaint. But the value of the property in suit is more than fifty lakh, for which the Ld. Advocate prays for withdrawal of the case with liberty to issue afresh before appropriate Commission. The prayer is allowed.

The case as such is dismissed and withdrawan with liberty given to the complainant for bringing the fresh suit in proper form in pecuiniary jurisdiction.

The documents filed by the complainant in support of the complaint be returned to the Ld. Advocate forthwith.

Let a plain copy be given to the parties free of cost as per CPR.
