Case called before the Lok Adalath.

Complainant present.  The learned counsels for complainant and OP are present.

On due deliberation, the learned counsel for the complainant and OP submits that if the entire principle amount with interest at 10% p.a from the date of periodical payment till the date of realization and also for refund of the entire court fee is just and proper for settlement. 

We are of the opinion that the said proposal is just and proper.  Accordingly, this complaint is liable to be disposed off directing the OP to pay the principle amount of Rs.3,24,000/- with interest at 10% p.a. from the date of periodical payment till the date of realization.  Since the matter is settled before the Lok Adalath, as there is not order as to costs. 


Any how, complainant is at liberty to seek the refund of court fee if any paid by him.

The principal amount with interest at the rate of 10% p.a. by way of compensation is payable in equal six monthly installments. First installment shall be paid on or before 31st January, 2022 and last installment will have to pay on or before 30th June, 2022.

If the Op failed to pay the said amount in monthly installments, in the event, the complainant is at liberty to file E.P.

To record this compromise, matter is place before the Regular Commission.

 

Case called in the open court.  Perused the settlement arrived at between the parties.  Accordingly, this settlement arrived at before the Lok Adalath is just and proper. We direct the OP to pay the principal amount of Rs.3,24,000/- with interest at the rate of 10% p.a. from the date of periodical payment till the date of realization by way of six monthly installments. First installment shall be paid on or before 31st January, 2022 and last installment will have to pay on or before 30th June, 2022. If the Op failed to pay the said amount in monthly installments, in the event, the complainant is at liberty to file E.P.

Since the matter is settled between the parties in the Lok Adalath, no costs is awarded.  Further the court fee if any paid by the complainant is fully refundable.  Ordered accordingly.
