Delay of 25 days in filing the appeal is condoned.

        State Commission has dismissed the complaint in default of appearance.  Appellant has filed the present appeal seeking restoration of the complaint before the State Commission along with copies of the order sheets of the State Commission.  Appellant has also filed amended memo of appeal incorporating respondent No.2 without any order from the Bench.

        Counsel for the parties have been heard.  Case is remitted back to the State Commission to decide it in accordance with law. 

        All substantive issues including incorporation of any other respondent be pursued before the State Commission.

        Parties, through counsel, are directed to appear before the State Commission on 6.8.2013.
