Learned counsel for the opposite party states at the bar that the parties have arrived at a settlement and the memorandum of settlement is reduced in writing and is duly signed by the respective parties. He has tendered a copy of the memorandum of settlement which is at Exhibit C I, which is taken on record. Learned counsel for the complainant after going through the memorandum of settlement filed today states that it is a true copy of the memorandum of settlement signed by the parties. It is also submitted that the parties have entered into the settlement voluntarily without any inducement or threat. Counsel for the opposite party states that the opposite party undertakes to abide by the terms and conditions of the settlement and shall adhere to the time schedule for delivery of the possession mentioned in the memorandum of settlement.

        In view of the aforesaid settlement between the parties and the undertaking given at the bar on behalf of the opposite party, learned counsel for the complainant seeks to withdraw the complaint.

        Complaint is accordingly dismissed as withdrawn with the observation that the opposite party shall bound by its undertaking.
