ORDER

Learned counsel appearing for the Appellant states that he has still not filed the application for substituted service. In this regard, order dated 07.10.2024 is reproduced below:

“Learned counsel for the Appellant sought an adjournment as the arguing Counsel is in personal difficulty.

By the order dated 05.09.2024, last opportunity was granted to file Application for substituted service as the Respondent No. 1 continues to be not served. This is an Appeal of 2019. If the Application for substituted service alongwith names of two newspapers, one in vernacular and another in English, widely circulated in the area, is not filed before the next date of hearing, then the Appeal would be dismissed for non-prosecution.

List on 13.11.2024.”

In view of the foregoing, on account of failure of the Appellant to comply with above stated order, FA is dismissed in default.
