Record is placed before the National Lok Adalat as per order dated 17.05.2024 for settlement of the matter.
Both the parties are present. It has been submitted by the Ld. Advocate for the complainant that during pendency of the instant case the OPs-1 to 3 requested the complainant to settle the dispute amicably in between the parties and accordingly the complainant the OPs-1 to 3 have mutually resolved all their disputes and difference and the complainant and the OPs-1 to 3 had duly signed and executed an Agreement for Settlement on 08.03.2024. Heard. Considered.
It appears that a petition was filed by the complainant on 04.04.2024 on the above with the prayer for passing an order on the basis of terms of settlement arrived at by and between the parties. Seen the photocopy of Agreement for Settlement dated 08.03.2024 from which it reveals that the settlement amount is at Rs.3,84,000/- which shall be paid by the OPs in two equal installments and the 50% of the settlement amount of Rs.1,92,000/- to be paid within 3 working days from the date of Agreement for Settlement i.e. 08.03.2024 and the rest of 50% of the settlement amount be paid within 45 days from the date of intimation to the OPs of the withdrawal of the complaint case.
In view of the above observation, it seems to us that the matter has been settled in between the parties on condition of payment of settlement amount.
Hence, the CDF Unit-II, CC No. 409/2022 is settled and disposed of finally through the National Lok Adalat.
The OPs are directed to pay the settlement amount of Rs.3,84,000/- as per schedule of Agreement for Settlement dated 08.03.2024 within the period as mentioned in the said Agreement.
If the OP transgress to comply the order within the stipulated period, the complainant is at liberty to put the matter into execution as per law.
Let a copy of this order be supplied to both the parties free of cost with proper endorsement.
