ORDER

Taken up through video conferencing.

1.       The matter relates to a buyers’ - builder co. dispute. The appellants in appeal no. 831 of 2015 (Satya Wati & 2 Ors.) were the buyers - complainants before the State Commission. The appellant in appeal no. 604 of 2015 (Emmar MGF Land Ltd.) was the opposite party – builder co. before the State Commission. 

2.       Learned counsel for both sides submit, on respective instructions, that the matter has been settled. 

3.       No comments of this Commission on the contents and ingredients of the settlement said to have been arrived at. 

4.       Learned counsel for the appellant in appeal no. 604 of 2015 (Emmar MGF Land Ltd.) submits, on instructions, that the appellant wishes to withdraw its appeal. 

Learned counsel for the appellants in appeal no. 831 of 2015 (Satya Wati & 2 Ors.) submits, on instructions, that the appellants wish to withdraw their appeal.

5.       Learned counsel for the appellants in appeal no. 831 of 2015 (Satya Wati & 2 Ors.) further submits that liberty may be provided to the appellants to revive their appeal if so required within 60 days from today by filing appropriate application.

6.       In the wake of the above submissions, the first appeal no. 604 of 2015 is dismissed as withdrawn without the option to file it again before this Commission, and the first appeal no. 831 of 2015 is dismissed as withdrawn with unfettered unconditional liberty to the appellants (Satya Wati & 2 Ors.) to revive their appeal if so advised within 60 days from today by filing appropriate application.

7.       The Registry is requested to send a copy each of this Order to all parties in the first appeals and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
