O R D E R

  1. The present complaint has filed against Opposite Party ( in short OP) under Section 12 of the Consumer Protection Act, 1986 alleging deficiency in service and claiming refund of Rs. 1,50,000 (One Lakh Fifty Thousand Only) with interest and other reliefs. Notice of the complaint was issued to OP however as none appeared for OP, OP was thus proceeded exparte vide order dated 27.01.2014.
  2. It is to be noted that as per the memo of parties, the office of OP is situated at F-132, Jai Vihar, Phase-1, Near Airforce Depot, Nangloi Road, Najafgarh New Delhi-110043, also at 3-A, 3rd Floor, Uppal’s M-6 Plaza Jasola District Centre New Delhi-110025 and at 211 to 213. IInd floor, Krishna Apra Plaza, Sector-18, Noida 201301.
  3. The complainant has not filed any document on record to show that the cause of action accrued within the jurisdiction of this District Commission/Forum. Thus we are of the view that this Forum/Commission does not have territorial jurisdiction.
  4.  In this regard, it has been by Hon’ble National Commission in Revision Petition bearing No. 578/18 titled Prem Joshi Vs. Jurasik Park Inn, decided on 1/3/2018:-as under:

In terms of Section 11 of the Consumer Protection Act, a complaint can be instituted inter-alia in a District Forum within the local limits of whose jurisdiction the cause of action only or in part arises. The case of the complainant is that the ticket for visiting the amusement park was purchased by him online in his office in Karol Bagh and it is the District Forum at Tis Hazari has territorial jurisdiction over the matters in which cause of action arises in Karol Bagh. The cause of action is bundle of facts which a person will have to prove in order to succeed in the Lis. Therefore, in order to succeed in the consumer complaint, the complainant will necessarily have to prove the purchase of the ticket in entering amusement park situated at Sonepat. Since the tickets was allegedly purchased at the office of the complainant situated in Karol Bagh, the District Forum having territorial jurisdiction over Karol Bagh area would have the requisite jurisdiction to entertain the consumer complaint.

  1. Thus we hold that this Commission does not have territorial jurisdiction to entertain and adjudicate the present complaint. The complaint is returned to the complainant along with documents for presenting it before the District Forum having jurisdiction, in accordance with law.

A copy of complaint and documents be retained for record.

The particulars of the complaint are as under :

A copy of order be supplied to parties free of cost.
